Terms and Conditions of Sale and Use

Preamble: Stakeholder status

These General Terms and Conditions (GTC) govern the contractual relationship between the lessee-guarantor and the lessor, defining the rights and obligations of each party.

The tenant is defined as the natural person responsible for the reservation.
He/she is the sole contact and assumes full responsibility for managing the reservation, complying with the rental conditions, and any damage that may occur during the stay.

The lessor is SARL Les Gîtes d’Hélios, registered under SIRET number 89113415700017, with its head office at 700 chemin de Bellut, 46230 Lalbenque.
The company is represented by Mrs Fanny Parre, in her capacity as manager, and holds an insurance certificate covering its obligations.

By booking, the renter certifies that he/she has read and understood the general terms and conditions of sale and use.
He/she undertakes to respect them, by validating them at the time of booking.
This validation gives rise to the issue of a receipt confirming the commitment entered into by the tenant.

Article 1 – Rental agreement

The rental contract is exclusively reserved for the use of accommodation in the gîtes located at the following address: Lieu-dit Hélios, 46230 Belfort-du-Quercy.
The SARL has two lodgings:

  • La Petite Eos: Sleeps up to 4.
  • Le Grand Hélios: Sleeps up to 7.

The landlord undertakes to welcome tenants with the utmost care, providing them with all the information they need for a pleasant stay.

The rental agreement concluded between the parties is strictly personal and may under no circumstances be transferred, in whole or in part, to third parties, whether natural or legal persons.
Any breach of this clause will result in the immediate termination of the rental contract to the sole detriment of the hirer, with no possibility of reimbursement of the amount paid.

 

Article 2 – Payment methods

Payment can be made by bank transfer or credit card.
The reservation is considered confirmed only upon receipt of the total amount of the stay.

Article 3 – Length of stay

The rental of our accommodation is subject to a minimum length of stay:

  • From September 1st to June 30th: 3 consecutive nights minimum.
  • From July 1 to August 31 (summer season): 7 consecutive nights minimum.

Bookings for less than 3 nights will not be accepted, except in the case of special offers.
The lessee who signs the rental contract for a fixed period may not, under any circumstances, claim the right to remain on the premises at the end of the stay, except by prior agreement with the lessor.

 

Article 4 – Arrival and departure times

  • Arrival time: 4 pm, as indicated on the rental contract.
    In the event of late arrival, the tenant must notify the lessor, Fanny Parre, by e-mail at contact@lesgitesdhelios.com.
  • Check-out time: The premises must be vacated by 10 a.m. at the latest on the end date specified in the contract.

Article 5 – Reception conditions and capacities

Our gîtes are intended for vacation rental with family or friends, or for coworking.
Festive gatherings are strictly forbidden.
The premises are designed to offer a friendly, peaceful setting, conducive to a relaxing stay.

Capacity per accommodation :

  • LA PETITE EOS: 2 double beds and facilities for 1 baby on request and subject to availability.
  • LE GRAND HÉLIOS: 3 double beds and 1 single bed, facilities for 2 babies, on request and subject to availability.

Reservation requests exceeding accommodation capacity will not be accepted.

 

Article 6 – Booking conditions and information required

When booking online, we ask for the full name and birthday of the renter and any accompanying persons.

If the booking request is accepted by the lessor, the lessee can provide a certificate of holiday insurance to the following address: contact@lesgitesdhelios.com

For safety and liability reasons, minors who are not accompanied by a legal guardian of legal age are not admitted.
The lessor reserves the right to cancel the reservation in the event of non-compliance with the admission conditions.
In the event of cancellation by the lessor, reimbursement will be made within 72 hours of cancellation.

 

Article 7 – Rates

The applicable rates are indicated on the day of booking and include all taxes, excluding tourist taxes, and may vary according to the calendar period.

 

Article 8 – Change of stay

Any request to change the date, length of stay or number of people is forbidden for reasons of safety and compliance with rental regulations.

 

Article 9 – No withdrawal

In accordance with article L121-21-8 of the French Consumer Code, reservations made via the Internet for accommodation services provided on a specific date or at a specific time do not benefit from a right of withdrawal.

Article 10 – Cancellation by the lessee

All cancellations must be notified in writing to the following address: contact@lesgitesdhelios.com

  • Cancellation more than 90 days before arrival: Full refund of the reservation amount within 30 days of cancellation.
  • Cancellation between 60 and 90 days prior to arrival: 50% of the reservation amount refunded within 30 days of cancellation.
  • Cancellation less than 30 days before arrival: No refund will be made, the lessor retains the full amount of the reservation.

 

Article 11 – Cancellation by the owner

In the event of cancellation by the lessor, the lessee will be refunded the full amount of the rental.

 

Article 12 – Condition of premises and use of equipment

  1. Inventory and condition report

The inventory is attached to the rental contract when the reservation is made online.
A receipt will be sent to the lessor upon confirmation of the reservation.

The tenant must report any missing, damaged or faulty items on arrival.

In the event of a problem occurring during the stay, the tenant is obliged to inform the owner so that the necessary repairs can be carried out as quickly as possible, thus guaranteeing his comfort and that of the next tenants.

  1. Use of equipment

The gîte’s equipment must be used in accordance with its intended purpose.
Damage to or deterioration of equipment may result in a deduction from the deposit, and additional charges may be applied if repairs exceed the amount of the deposit.

We recommend that you take out holiday insurance to ensure that your stay runs smoothly.

  1. Baby equipment

Baby equipment is available on request and subject to availability on the date of stay.

  1. Pool use

Access to the outdoor swimming pool is strictly reserved for registered guests.
Children’s safety is the responsibility of the tenant.
Supervision must be rigorous and continuous, provided by a responsible adult.
It is crucial to equip young children with certified flotation devices and never leave them alone in the water, even for a short time.
The lessor does not provide flotation equipment for children.

After swimming, all toys and buoys must be removed from the pool, and the roller shutter, the pool’s safety device, must be closed.
This device in no way replaces active, constant adult supervision.

To avoid any risk of falling outside the pool, the use of suntan oil is prohibited.
What’s more, only biodegradable, environmentally-friendly sunscreens are permitted.
Some products affect water quality, stain the liner and interfere with the filtration system.

The pool is winterized when the weather is no longer favorable, the lessor being the sole decision-maker for winterizing the pool.

  1. Terrace use

In bad weather, deckchairs should be stacked and stored in a corner of the terrace, or in the garage in case of strong winds.

For safety reasons, the parasol must be closed and strapped down when you leave the pool, and must not be used in strong winds.

  1. Instructions for the heat pump

It is strictly forbidden to tamper with the heat pump or any other pool service equipment.

  1. Use of billiards and table soccer

It is strictly forbidden to place glasses on the gaming tables.

 

Article 13 – Security deposit

  1. Amount of deposits
  • LE GRAND HELIOS: €1,200
  • LA PETITE EOS: €800

A deposit cheque will be requested, but will not be cashed, except in the case ofserious breaches of the house rules. The same applies in the event of damage to or theft of equipment, and if the equipment has not been reimbursed on the basis of proof provided by the lessor.

The lessor reserves the right to withhold all or part of the security deposit depending on the amount allocated to any damage to the property. if an amicable solution has not been found, such as reimbursement of the cost of broken or lost equipment.
If the cost of repair or replacement exceeds the amount of the deposit, the hirer undertakes to pay the full cost of restoration.

The tenant is informed that his holiday insurance may be used to cover additional costs.

  1. Return of deposit

If no damage is found and the accommodation is returned in a satisfactory state of cleanliness, the full deposit will be returned to the tenant when the inventory is made.

Article 14 – Damage to and restoration of accommodation

  1. Departure instructions

A welcome booklet is provided by e-mail and is available in each gîte with detailed instructions for cleaning the premises on departure.
The tenant must leave the accommodation clean and follow the instructions provided.

  1. Damage and insufficient cleanliness

If the accommodation is not returned in a satisfactory state of cleanliness, the lessor may invoice additional cleaning costs and deduct the deposit.
In such cases, the tenant will be provided with a damage report, including photos, and a detailed invoice for the costs incurred.

 

Article 15 – Holiday insurance / Home insurance extension

  1. Insurance certificate

The tenant can request an extension to the home insurance cover. This covers damage and exceptional cleaning costs over and above those covered by the deposit.

The lessee can contact his insurance company to obtain a certificate and send it by e-mail to the lessor at the following address: contact@lesgitesdhelios.com

Good to know

Vacation liability is usually included in your primary residence insurance.
The price may vary according to the formulas and optional cover taken out.

Holiday insurance is an extension to your home insurance policy, providing temporary protection in your vacation home.
For a worry-free holiday, we invite you to contact your insurer, who will provide you with all the information you need on holiday insurance.

Article 16 – No smoking

Smoking is strictly prohibited inside the gîtes.
Failure to comply with this rule will result in a penalty, deducted from the security deposit.
In the event of damage or additional cleaning costs caused by smoke, additional charges will be billed to the tenant.
For reasons of hygiene and fire safety, ashtrays are provided outside the gîtes.

Article 17 – Pets

Pets are not allowed in the gîtes.

 

Article 18 – Responsibility for the parking lot and other areas of the estate

The Lessor accepts no responsibility for accidents, theft, damage or any other damage to vehicles or valuables left in the parking lot.

Article 19 – Tourist information

The lessor provides information about the region’s tourist attractions and the services available nearby, with the aim of making your stay a pleasant one.

This information is provided on the website, by e-mail and in the welcome booklet for information only, and the lessor cannot be held responsible for any changes or cancellations.

Article 20 – Leaving and returning the gîte

Gîtes must be vacated by 10 a.m. at the latest.
You are asked to leave the premises in an acceptable state of cleanliness and to store the equipment entrusted to you at the location indicated in the welcome booklet.

A key for the entrance door is provided for the gîte La Petite Eos and a key with a remote control giving access to the garage is provided for the gîte Le Grand Helios.
These items are the property of SARL LES GITES D’HELIOS.
Reproduction is strictly forbidden and will result in prosecution.
